GENERAL TERMS AND CONDITIONS

Section 2 - Scope

These general terms and conditions of the Spanish Riding School - Federal Stud Piber public limited company (hereinafter SRS), as in effect at the time of ordering, shall apply to the ordering of goods from the assortment offered in the SRS webshop.

By placing an order the customer accepts these terms and conditions. SRS does not recognise any deviating terms set out by the customer, unless SRS has expressly agreed these in writing.

If individual provisions of these terms and conditions should partly or fully contradict mandatory statutory provisions, the remaining provisions of these terms and conditions shall remain unchanged.


Section 3 - Contractual language

The contractual language is German. If questions regarding the interpretation of individual provisions arise, only the German version of the terms and conditions shall be valid.


Section 4 - Conclusion of the contract

All product offerings in the SRS webshop are understood as an invitation for the customer to submit an offer. By placing an order (clicking the "order" button), the customer makes a binding offer to conclude a purchase contract with SRS.

When the customer places an order with SRS an email confirming that SRS has received the order (order confirmation) will be sent. This order confirmation does not signify that SRS accepts the customer's order. It merely informs the customer that SRS has received the order.

The purchase contract with SRS is not concluded until the ordered goods have been dispatched to the customer.

Section 5 - Product delivery, purchase price, shipping costs, terms of delivery

The purchase price for ordered goods, calculated from the price lists and pricing information at SRS and in the SRS webshop, shall always be deemed agreed. All prices include VAT. Delivery costs and any customs duties are not included in the price. For deliveries abroad the customer shall be responsible for any incurred taxes, fees, customs duties as well as the transport costs. For deliveries of goods to customers whose residence (domicile) lies outside the European Union, a tax-free export delivery (Section 7 of the Sales Tax Act - UStG) is carried out in accordance with present legal requirements. The delivery of goods to non-Austrian companies with registered offices within the European Union can be carried out as a tax-free intra-community delivery provided that the legal requirements for tax exemption are met, more specifically the existence of a business activity and a valid VAT number.

Price changes and misprints are reserved. Customers will be informed of any possible price changes prior to the dispatch of goods.

All products in the SRS webshop are only sold in standard household quantities.

Delivery is by post. Postage and packaging costs are generally charged at a flat rate, as follows:

Orders will be processed by SRS within 5 working days. Depending on the chosen delivery service the delivery time within Europe is approx. 5 - 7 days and overseas shipping takes approx. 10 - 15 days. In rare cases some delays may occur.

If SRS cannot accept or fulfil the order because the goods are not available, the customer will be notified by email as soon as possible. In this case, any payments that have been made will be refunded.

If it is not possible to make a delivery because the customer is not available at the supplied delivery address, even though the customer was given reasonable notice of the delivery time, the customer shall bear the costs of the failed delivery.

 The liability of SRS is specifically excluded when the goods have been confiscated or destroyed by the authorities in the land of destination because the land of destination prohibits their import or distribution.

Section 6 - Payment options and terms of payment

SRS only accepts the payment types displayed to the customer during the order process. Payment must be made by credit card (Mastercard/Eurocard, Visa or American Express). Credit cards will be charged on the day of invoicing.

Payments must be made in Euros.

Until full payment has been received, the goods remain the property of SRS.

 

Section 7 - Right to withdraw from the contract

No purchase contract will be concluded with SRS within the meaning of Section 4, if SRS is unable to deliver the ordered goods through no fault of its own. In this case, the customer will be informed immediately that the ordered product is unavailable.

The customer can cancel his contractual declaration in writing, for example by letter or email, within two weeks and without giving a reason or by returning the ordered goods, unless one of the exceptions to the right of withdrawal, in accordance with Section 5f of the Buyer Protection Act [KSchG] applies. In particular, there is no right to withdraw for audio or video recordings, e.g. CDs, DVDs and software, if the goods have already been unsealed by the customer.
The customer shall bear all shipping costs, if the purchase contract is cancelled.

In the event of a customer effectively cancelling a contract, any goods and services already received by either party must be returned. If the goods or services received can no longer be returned in mint condition, it will not be possible to withdraw from the contract.

Goods must be returned to SRS in unused and undamaged condition. The customer shall bear the cost of returning the goods.

Only goods ordered from the SRS webshop can be returned to SRS. The right to withdraw does not apply to goods bought on site in the SRS shop.


Section 8 - Warranty, guarantee, liability

The statutory warranty, liability and guarantee provisions always apply.

If the goods have a proven defect, SRS has the right to improve or replace these in accordance with general warranty conditions. If no satisfactory replacement is made, the customer is entitled to either a reduction of the purchase price or to withdraw from the contract. However, said withdrawal is excluded, if the defect is minor and insignificant.

The notification of defects is also invalid if it relates to reproducible defects and if, in the event that the provisions set out in Section 377 of the Corporate Code (UBG) do not already apply, it is not documented in writing within two weeks from delivery of the goods.

SRS is not liable for damages that are not caused to the delivery item itself; in particular, SRS shall not be liable for lost profits or other financial damages to the customer due to defective, delayed or failed deliveries.

Despite the utmost care, defects in the products cannot be excluded. SRS assumes no responsibility and is not liable for the content of the purchased items and in particular is not liable for the formal or substantive accuracy or regularity of the information, texts, images, sound or video recordings contained therein.

 

Section 9 - Data protection and use of customers personal information

All customer data resulting from enquiries and orders is used by SRS to process orders, deliver goods, provide services, process payments (in dealing with invoiced orders to carry out any necessary checks) and to continuously improve customers shopping experience. Customers’ personal information is never disclosed to third parties.


Section 10 - Applicable Law

Austrian law applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of fulfilment is Vienna. By agreement the place of jurisdiction, is the competent court in Vienna

If a customer is a consumer within the meaning of the Buyer Protection Act (KSchG), the mandatory provisions of the Consumer Protection Act shall apply."

Changes and additions to these terms and conditions, as well as any contracts concluded on their basis, must be made in writing.
